Restorative Justice in Indonesia's Criminal Justice System

Examining the paradigm shift from a retributive to a restorative approach in criminal law enforcement.

A restorative justice approach is increasingly being adopted in Indonesian criminal law enforcement policy, including through the diversion mechanism for children in conflict with the law under Law No. 11 of 2012 on the Juvenile Criminal Justice System, as well as restorative-justice-based prosecution discontinuance guidelines issued by the Attorney General's Office.

This shift emphasizes restoring the relationship between the offender, the victim, and the community, rather than focusing solely on punishment. For academics, this development opens up discussion on the limits of applying it to offenses of varying degrees of severity.
